Catholics and non-Catholics sending children to schools and churches under your supervision should be guaranteed the opportunity to make a fully informed consent decision relating to turning over confidential information to representatives of the Diocese, that may someday be publicly disclosed in a judicial proceeding.
In addition, I do find it coincidental that the law firm of Sullivan & Ballog represents the LA Archdiocese, the Diocese of Orange and the OC Sheriff's Department simultaneously. One can only imagine how much information sharing is now available to protect all three entities from monetary damages in a court of law, based on "litigation privilege." I am respectfully requesting that the Diocese of Orange fully disclose the legal policies and procedures currently in existence within the Diocese of Orange, all based on false information and belief that "pastoral privilege" will be honored at all times, to all persons equally, without exception. Please consider posting the following:
"The Aliados' children attended St. Paul the Apostle (St. Paul), a parochial school operated by the Archdiocese. The children had confidential communications with various St. Paul employees, including the school psychologist. The Aliados submitted applications, intake information sheets, health and developmental information, and financial information to St. Paul. They were assured that their confidential information would remain private, and not divulged to third parties.
... The Aliados were sued by the parents of a St. Paul student (the underlying lawsuit). During the underlying lawsuit, the Aliados' adversaries served St. Paul with a subpoena, seeking the production of personal records regarding the Aliado family... The Aliados had no idea that the subpoena was served on St. Paul.
... St. Paul furnished the Aliados' adversaries in the underlying lawsuit with information about the Aliados. This included applications; intake information forms; health and developmental information; educational records; a "suspected child abuse report" involving one of the Aliado children; written communications between the Aliados and the school principal regarding the child abuse report; internal memoranda documenting the substance of confidential communications between St. Paul and Mrs. Aliado; and financial information concerning the Aliados' tuition payments.... St. Paul's principal and school psychologist "voluntarily provided declarations" to opposing counsel in the underlying lawsuit, revealing private information. "
Catholics and non-Catholics have not been informed that your legal advisors have the right to use their personal and private information in a judicial proceeding, without their permission or knowledge. This is a denial of due process of the law and a blatant violation of the False Claims Act.
With respect, I am requesting that you immediately inform all persons associated with the Diocese of Orange at ALL Masses this Sunday, that your legal advisors have the ability to deny privacy rights, without full consent. Is this what Jesus would do?Without justice, there will never be peace. Without peace, faith and our countrys laws are empty.
