If these killings were not justified by the exigencies of war, they fall outside the scope of what is known as combatant immunity. Whether characterized as war crimes or as criminal homicides in violation of the Uniform Code of Military Justice, the underlying premise is the same: even in war there are limits on when it is permissible to kill.
