US Business and Government Colluding to Fill American Jobs with Foreign Workers?

My guest today is civil rights lawyer, James A. Otto.  Welcome to OpEdNews, James. You recently filed an unusual lawsuit. Can you tell our readers about whom you're suing and why?

Hello, Joan, and thank you for asking me to speak with you.

In short, my clients are 18 of the over 8.4 million other Americans, fired from their job because U.S. employers wanted to import immigrants to take away the U.S.-based jobs. The threat is to all Americans from their employer who may segregate them out of the work force and replace them with a new immigrant.

In fact, the number one cause for American job loss during the recession of 2008-2010 were "legal immigrants" who are imported by U.S. corporations to replace U.S. workers.

The U.S. Government's own research shows that legal immigration is used to segregate U.S. workers out of the job market. The statistics are staggering in the proof that more than two million Americans per year are replaced by imported immigrants.

How can this be, James? It sounds more like a headline I'd read on a supermarket tabloid. Tell us more.

You won't read about these facts in any supermarket tabloid. Rather, by reading the U.S. government's publication of its own investigation into the corruption and abuses of the Employment Preference Visas, you will know everything that I now know.   

For example, the January 2011 Government Accounting Office [GAO] investigation outlines the scheme employers use to circumvent the law. Congress agrees with the GAO and, according to Senator Dick Durbin, "[The] visa program is plagued with fraud and abuse and is now a vehicle for outsourcing that deprives qualified American workers of their jobs."

That is the issue --  immigrants imported to deprive qualified American workers of their jobs. The Department of Homeland Security reported the number of immigrant imported by U.S. employers that take U.S.-based jobs during the recession as over 8.4 million.

Two million jobs per year! Yikes! The GAO has investigated and reported and Congress has objected to these underhanded practices. So, who's spearheading this drive to covertly deprive Americans of much needed employment in this trying times?   How have they been able to pull this over on us? And what can we do about it?

Congress has NOT objected to these underhanded practices. Wall Street has lobbied Congress for no limits on employment preference immigration with such energy that, according to Professor Norman Metloff, "Prominent members of Congress publicly admitted that they approved the [employment preference visas] because of industry campaign contributions."

The government's policy is founded on Alan Greenspan's plan to allow foreign workers free access to U.S. based jobs to force the American middle class to compete with foreign wage scales. (See, "The Age of Turbulence." and http://www.youtube.com/watch?v=oqx88MyUSck&feature=related

Elaine Chao, wife of Congressman Mitch McConnell, and President Bush's Secretary of Labor from 2001 to 2008, stated the government's policy in her Strategic Report 2006-2011, on page 35, that "a qualified U.S. worker can be displaced from a job in favor of the foreign worker." http://www.scribd.com/doc/1628441/Department-of-Labor-strat-plan-20062011

On December 7, 2011, Secretary of State Hillary Clinton, through the U.S. Embassy in India, announced that the State Department has authorized the U.S embassy to accept all visas, including H visas, under the limitless B-1 visa and to allow the admission of a limitless number of foreign workers into the U.S. to take jobs that millions of unemployed Americans could and would do. http://newdelhi.usembassy.gov/types_of_visas/temporary-employment-holp/b1-in-lieu-of-h2.html

The practical implications of the State Department's conduct is that every U.S employer can now hire as many foreign workers as they desire to replace all American workers. Senators Dick Durbin (D-Illinois) and Charles Grassley (R-Iowa), are attempting to limit the harm to Americans and American jobs by proposing to limit the number of imported foreign workers to 50% of a company's U.S. workforce, the so-called 50/50 rule. http://www.computerworld.com/s/article/9210040/Hatch_wants_White_House_to_seek_H_1B_expansion

To study how U.S. business is "gaming the system," I used the 10K S.E.C. filing of Cognizant Technology Solutions, Inc. as it tells its shareholders about the business model.  Cognizant stated that they will "provide a continual funnel" of Indian students from schools in India to clients in the United States.  The business model is to change from supplementing U.S. business staffing needs to replacing American workers. Cognizant stated that the majority of their "technical professionals are located in India, and the vast majority of our technical professionals in the United States and Europe are Indian nationals who are able to work in the United States and Europe only because they hold current visas and work permits."

Cognizant has a recruitment program in India with extensive recruiting efforts at colleges and technical schools in India. However, Cognizant does no recruiting or training for U.S. workers or students.

What can be done about it? Americans should follow the example of my clients -- report to the Department of Justice and then sue all U.S. businesses that import immigrants instead of hiring American workers.

This is a huge, untold story, James. What can we do to get the word out? I don't know how many of us are going to initiate a lawsuit but if more people knew what's going on, it would certainly make them plenty mad.

Americans need to stand up for America. The best way to stand up and be counted is to say something. For an example, facebook and twitter launched the "Tea Party" and the "Arab Spring" when individuals in a thousand different communities started speaking out and questioning their government's policy though social networking.

Congress and Wall Street are getting away with the betrayal of Americans because corporate media keeps it secret. If no one is talking about the issue of importing immigrants to take American jobs away from Americans, then there is no problem.

So, if you care about this issue or if you just care about America, then email someone; facebook your friends and ask them to spread the message; or twitter your followers and ask them to spread it on. The more people talking about this issue, the louder the issues become until, eventually, all Americans know of the betrayal. Then, the action will start.

How did you get started with this? Can you tell our readers a little about yourself?

I have taken up this cause for two reasons. First, the future of ALL CHILDREN, including my two young children, demands the elimination of the employment preference visas so that they do not have to live in the slums of Mexico or India to have a job. It is true that today's college graduate is being forced to look to Mexico or India for low pay job opportunities.

Second, I love America. I enlisted in the U.S. Marine Corp to served my country and, if necessary, risk all I am. While traveling around the world, I began to appreciate the American Dream. I learned that no other country in the world offers its citizens a dream to work hard so you can leave your children better off than yourself.

When I met my clients, I saw how U.S. employers have destroyed the American Dream. It did not matter that they worked hard and gave their best and were recognized as talented. That is when you should have some permanence with the company. NOT SO. Today, your employer will fire you and replace you with an imported immigrant. American college graduates have no chance at being hired into a U.S. based job, much more a good, long- term career in a profession - not by a U.S. company. Those jobs go to imported immigrants.

U.S. employers demand that you give up your dream of success. They import immigrants who are compliant and will not complain about being paid too little, living in a slum, and too scared to stand up for themselves.

I stand here ready to fight for the American Dream. I will battle those U.S employers who fire Americans to give US. based jobs to newly imported immigrants.
