Beyond jail overcrowding and looking at a broader view of our system, the same questions must be addressed: Where is the balance between the need for social justice and the need for criminal justice? Who is best able to service the needs of each of those requirements?
The solution lies with both types of release. Let the commercial bail industry focus on those defendants who need to be held accountable and brought through the system as effectively and efficiently as possible, while pretrial services agencies can focus on helping the truly indigent and those who can't help themselves. This way all stakeholders -- society at-large -- wind up winning.
