Contact Sen. Kennedy to thank him for his work on the Judiciary Committee last week and ask him to filibuster Alito confirmation whether he has the votes or not and whether Frist threatens the nuclear option or not.

Tell him to forget the Gang of 14. If this is not worth going to the wall for, what is? If not now, when?

People didn't think we could defeat Bork either, and we did. We can do the same now with Alito.

At a meeting with two Kennedy aides here in Boston last week, a delegation of us was told that Choice was the key issue. We went in with other issues and I am keenly aware there are many other important issues, but think it is important to press the one the officials see as key, the one most likely to change their minds. You might want to remind Kennedy of the vote in MA several years ago, when one member of the state legislature changed his vote unexpectedly and unknown until he did it - and we were saved from bringing back the death penalty in MA by this one surprise and changed vote at the actual time of the vote, not before. If they had not held the vote because they did not have enough votes to defeat the push for death penalty, we would be stuck with the death penalty in MA
