Glenn Greenwald lays out the argument that FISA in its original mode has made it certain that the immunity of telecoms is not and cannot be enforced legally. Three Appeals Court judges have ruled pretty much along that line already. Very legal, well documented, this column is something it will take a constitutional legal mind to appreciate.
