I will argue that Roberts, though he cites U.S. Supreme Court precedents in favor of his view, goes far beyond these precedents, venturing into the very kind of judicial activism conservatives like him most condemn. Ultimately, his dissent is so extreme as to, in effect, reject the protections of the federal Endangered Species Act -- Hilden
