Speaker Pelosi, You Are Part of the Problem

We noticed yesterday online and again this morning in the local newspaper that Cindy Sheehan will, as an independent, challenge the Congressional seat of Nancy Pelosi out in San Francisco.  If this is the way it has to work, so be it.  Speaker Pelosi is outside the Constitution by declaring impeachment to be off the table.  No one, not even the nurturing first femme Speaker can put aside essential features of our Constitution.  Let me be plain, it is OUR Constitution, not Nancy Pelosi's or Rahm Emanuel's or Steny Hoyer's.

The Founding Fathers understood in clear detail the failings of human beings.  The Constitution is specifically written to curb the power lust of individuals.  Yet, as many have said, the Constitution does not make the checks each of the separate and equal branches of government have against the other branches so easy to employ that they would be used indiscriminantly.  That is the genius of the Constitution.  It is all the more folly, then, for the Legislative Branch to remove its own teeth and sit idly by while Washington sinks deeper into the consequences of a corrupt and dishonest Executive.

The calls for impeachment are growing, Speaker Pelosi.  Your illegal act has been called out and you have, given the goodwill you are blessed with, a few days in which to reverse your unconstitutional position.  You have only a few days in which to vindicate your gender, for if you do not get back within the real and necessary provisions of our Constitution, then you will have sullied the reputation of women politicians immeasurably.  You need to know how to fight in this world, and you need to know that a political fight is honorable and necessary.

Cindy Sheehan should understand that impeachment of Dick Cheney is the first step toward impeachment of George Bush.  Let us hope that she is flexible enough to make this change in her challenge to Mrs. Pelosi.

Yes, it will be an process fraught with misgivings and distress.  Impeachments always are full of emotion and inefficiency and almost intolerable confusion.  Impeachments are necessary when the facts say they are and, Nancy, there are volumes of facts now, and they all speak to the one compelling conclusion.  Dick Cheney and George Bush have lied, misrepresented, broken U.S. and international law, and are in a massive coverup operation to obstruct justice.  Their lackey, Alberto Gonzales, is just as culpable, and must also be impeached.

Your job, now, Speaker Pelosi, is to put it back, reverse your position based on the evidence, and find a Sam Ervin and Sam Dash to lead the process.

Perhaps

Does an act against the letter and spirit of the Constitution have to be named in Law to make it illegal?   I do not think so.  Pelosi's declaration that impeachment is off the table was "outside her authority," but more importantly "outside ANYONE'S authority."  There simply is no authority, not even in the Supreme Court for declaring standing provisions of the Constitution to be null and void (or off the table).   Is acting outside one's authority a criminal act?  It really depends on the consequences of the act.

I'd agree with you if "off the table"

meant "null and void".

But I think Pelosi used deliberately ambiguous language that she could argue doesn't amount to breaking the letter of the constitution. The spirit is always arguable unless you can get the letter as well. And if we are going to argue that the letter has been broken we probably should include a quote or reference to which part of the constitution.

Perhaps the appropriate response to Nancy Pelosi is to email write and/or call her DAILY with inquiries of "are we there yet"? "What more would it take to get impeachment ON the table"? "What does off the table mean in terms of your article 6 duty to support the constitution - does it mean only the bits that don't mention impeachment"? I've been Googling on impeach and impeachment daily and sometimes hourly. Cindy Sheehan's challenge seems to be getting widely reported. Perhaps Cindy hasn't got a hope of beating Nancy - I don't know, the point is though the Cindy is succeeding in making her story THE STORY.

My point is that if Pelosi is looking for a line of least resistance when impeachment should be on the table then she should be denied it. Let a thousand Bart Simpsons nag in her ear.

Conyers was recently pointing out, with respect to the polling just done, that Americans may be able to frighten Bush with impeachment by calling for it to be put on the table. I am still trying to work out whether Conyers is being cagey or cautious - calling for reinforcements from the people or seeking to skirt his own responsibilities in bringing forward more of the information that Bush and Cheney want suppressed. The problem with getting impeachment up is that it has to be political as well as legal so it has to be popular to be successful. And some of the lines of argument are hard to make in a way that ordinary citizens care about and can follow.

I think I can make a pretty strong case that Bush should be impeached for the illegal invasion of Iraq for instance using just what Bush has done and said publicly. But because the standard of "high crime" has to be reached and the standard isn't specified in the constitution there are a lot of challenges in persuasion.

The Libby decision and the recent poll help set the scene but there is a lot of persuading yet to be done.

Honing the Blade

The problem, as I see it, is that Speaker Pelosi has listened to advisors like Emanuel and others who believe that the Bush administration AND the Republicans can be brought to their knees by "informal means" and to a much more politically satisfactory result than by impeachment.  That may even be true in some sense.  The problem with that is that it is fighting political corruption with political wile, rather than standing up to the intolerable with the certitude of the Constitution.  And, the other problem is that Cheney and Bush and Gonzales can do a great deal of harm in the next twenty months.  Emanuel and his ilk think not, but the opportunities for mischief are huge and the stakes very high.

Speaker Pelosi, You Are Part of the Problem

Mr. Brett,

It's not only Pelosi but Conyers is part of the problem also.

When Pelosi stated that impeachment was off the table, Conyers, the man who spent many months in impeachment hearings when he was in the minority, stated that impeachment was off the table when he became the majority.

If Pelosi and Conyers don't get their shit together before the 2009 election the democrats are going to lose big in 2009
