By ignoring Bush administration war crimes, Obama is reinforcing the two-tiered justice system that already is too apparent in this country. And, although Obama is attempting to remove the moral stain of the Bush administration, his unwillingness to make a clean break with Bush policies or to support investigation of war crimes undermines his own efforts. America cannot reassume the moral high ground when it refuses to investigate its own war crimes. Obama is thus inadvertently reinforcing the justified perception of other nations that, once again, America is acting as though it is the Exceptional nation, and is, therefore, above the law.
