The Constitution Of "The Direct Democracy Republic Common Wealth Of The United States Of America" -- Part 2 - Our New Bill Of Rights and Responsibilities -- Article 4 -- Our Basic Alienable Economic Rights and Responsibilities:
(22) We The People, Of The "New Direct Democracy Republic Common Wealth United States Of America" declare, insist upon and establish, Our Right to bring under control, the imbalances and depredations of Capitalism and find ways to make it a more suitable service for Our New Ways Of Governance and Life, or replace it with a "better" economic system. ("Mutualism", "Steady State Economy System", etc)
One of the goals of this "Right Of The American People" is to limit the size and power of corporations, so that their influence doesn't reach levels of the controlling exercise of tyranny.
The Responsibility of this Right is that We achieve this desperately needed goal, over "Dominion Corporatism", as Peacefully and as Fairly, as possible; in the understanding of the resistance to this of corporate capitalism.
It is not necessarily Our goal to destroy this worthy, but dangerous Human Economic Way of the Sacred Finite Quest For Prosperity, but to enable it, through careful, deliberate and vigilant principles, to serve More of The American People than it has heretofore done. Much More!
The Standards that We establish for the control of dynamic and dangerous, capitalism, are the first and most important ones that We can do as a flourishing Direct Democracy. Of course the control of capitalism would include the control of the international banking cartels, the military/industrial complexes and the corporations.
(23) The Qualified Employee's Right to a $15.00 per hour Minimum Living Wage, in full time (40 hours per week) employment from the adult age of 18.
The Responsibility of this Right is that We make Ourselves Individually worthy of this, by the age of 18, in the working skills We need to use for the minimum work skills and performance requirements.
It is hoped that higher wages would develop from this minimum, with improvement in work skills and attendance performance"plus the duration of employment on one job. (A raise every year after three years on the job?) This could be said to be one of the American Rights Of Passage into Adulthood. Another being the right to serve and possibly risk Our Lives in Our Military Systems. Here too, Standards for Eligibility for Adult Wages have to be developed.
(24) The Right of all "Part-Time (at least one hour less than 40 hours per week) Workers" to a National minimum-minimum of $9.00 per hour and up to a maximum-minimum of $14.00 per hour"which is a Fairness response to Good Work. The Responsibilities of this Right is that We the Employees learn all We can and do Our Best Job.
The Responsibilities in this of Employers is that We recognize progress of young workers in becoming better workers and reward them accordingly. These principles would mostly apply as regards the Disabled Workers too.
Here again National Standards should be developed to guide Us in these working situations. We should Hope and try to eliminate the tendency among certain Employers to hold an Employees wages to $14.00 per hour, by letting them work only 39 hours per week. The next Right addresses this particular need for Fairness.
(25) The Right of an Entrepreneurial or corporate Employer, of a non-worker owned and operated business, to establish a "ceiling" on full-time hourly wages, once $30.00 per hour has been reached.
The Responsibility of this Right is to prevent inflationary pressure that comes from high wages. This to be utilized in conjunction with other anti-inflationary measures undertaken in Our New Economy. Ceilings prevent excesses. Unions should respect these ceilings. So should Landlords.
(26) The Right of the Hourly Wage Worker to receive a minimum of: "Time and a Half" for overtime up to eight straight hours over the standard full time shift of eight hours. "Double Time" for eight more hours over the first sixteen straight hours worked. "Triple Time" for eight hours over the first twenty-four straight hours worked.
It seems irresponsible (to this single author), within the scope of this "New Constitutional Bill Of Rights", to think of working more than thirty-two hour straight through. The American Citizens will decide.
(27) The Right of Women and all social component ethnic and minority groups to Equal Pay For Equal Work.
The Responsibility of this Right is that We Truly provide an acceptable performance criteria of "Equal Work" within the parameters of Our Standard for the meaning and spectrum of this Fairness Application.
(28) The Right of "Members of American Society" to receive, (when complying with the "Earning Standards Range" developed for this part of American Society), to the "American Minimum Earned Guaranteed Income".
The Responsibility of this Right is for the "Members Of American Society Class" to fulfill the minimum requirements in qualifying for the "American Minimum Earned Guaranteed Income""which would provide a minimum income for living at what would be considered just above the "Poverty Level".
Accompanying this Income would be State and National Government programs, designed and intended to assist and "raise" as many of this social strata into full American Citizenship, as possible.
(29) The Right of True Citizens to "Earn" the "Second and Third Level American Earned Guaranteed Income" when complying with the "Living Standards" thereof.
The American Citizens, of these Guaranteed Income Levels, are Responsible for complying with the qualifications and requirements for achieving them. See Part 5, of this Third American Constitution, for a description of this National Guaranteed Income Program.
(30) Our Farmers and Farm Workers, Of the Family Kind and the Corporate Kind, shall have the Right to a "Fair Living Wage Income".
The Responsibility of this Right is that We see to it that the income derived from the raising and selling of agricultural products, is on a par with the incomes of the industrial sectors. The same hourly wages should apply, or equal percentage distribution of profits should be awarded, that reflect the standards enjoyed by Worker Owned and Operated Businesses.
(31) The Right of American Worker Owned and Operated Businesses Individual Laborers of "lower skilled toil", to a Fair Share of profits accrued in the production and initial sales of services and products.
The Responsibility of this Right is that We recognize that all jobs are difficult and that all the jobs in the operation of a business are equally valuable.
Each task, if skillfully performed, contributes, in its special way, to the success of the business. We recognize the necessary, therefore valuable, contribution that "lower skilled laborers" perform in the performance of their duties.
(32) The Right of an Entrepreneurial, or corporate, Business Founder, to all the businesses profits, after the payment of the Fair Living Wages, Fair Share Of Taxes (If there are any) and the Proper Maintenance Overhead, referred to in this Constitutional Bill of Rights.
It is Our Responsibility, as True American Citizens to give proper credit to and recognition of the Entrepreneurial Men and Women who have worked hard to establish a successful profit making enterprise within the parameters of the New Standards indicated in this Direct Democracy Constitution Bill Of Rights.
Further, the Responsibility of this Right is the continued recognition and support that is Fair to embrace, when a Entrepreneurial, or corporate, (sometimes the one becomes the other) Human Founder:
{A} In a manner that functions within the principles and mandates of this New Direct Democracy Constitution Bill Of Rights and the High Moral Standards Of Decency that form the foundation of this social contract of Our New Nation"
and
{B} Claims as their Right the receiving of this "Majority Profit", up to the Wealth Ceiling also established in this documented will and agreement, of the American Majority. This "Founders Share" is tribute to this Fairness Truths of this Sacred Document.
(33) The Right of the American Worker Owned and Operated Business Founder to receive one equal share plus one more from the profits of the "W.O.O.B.U.S" business.
The Responsibility of this Right is that the American Citizen Worker Owned and Operated Business Founder maintains a high integrity and honest accountability appraisal in the distribution of profits within their business.
(34) The Right to "Lease", from the American Common Wealth, available Property for a Home and Business. (Limit: Two per customer -- size varies -- special considerations for corporations that need More property for real production)
The Responsibility of this Right is that We all have an equal opportunity to gain access to American Land to live on and earn an income on. Placing "unused" American Land in a Common Wealth Structure, makes it available to More Americans who might have the desire and ambition to contribute in this way to Our Society.
Of course, lands held in trust for recreational and National Natural Wonders heritage, are firmly excluded from Public Development.
