In their next term these noble men will decide between 3,000 plaintiffs and Johnson & Johnson. The plaintiffs, or the relatives they're representing, have suffered heart attacks, strokes and in at least 40 cases death. These plaintiffs are the victims the Ortho Evra birth control patch. The patch released far more estrogen than its label disclosed--amounts that can cause, eh hem, heart attacks, strokes and in at least 40 cases death. Scientists at Johnson & Johnson knew this from a clinical trial, and altered their results to show the patch released safe levels of estrogen.
In all likelihood, the Supreme Court will rule that Johnson & Johnson, despite the Anti-Life results of its Ortho Evra patch, is unaccountable for these tragedies because the FDA approved the patch. The FDA can judge the safety of a product by the results of the clinical studies that pharmaceuticals perform for their own products; results that, in this case, were falsified.
The ruling would set a terrible precedent: pre-emption. Big Pharma could literally never be held accountable for consequences of fatal duplicity in the marketing of a product as long as the FDA approves it. The FDA is over-worked and under-staffed. They simply cannot rise to the challenge of policing Big Pharma.
Forever after this ruling, we will be Big Pharma's guinea pigs, without recourse to justice when our four little legs are sticking up stiffly toward the sky.
Long live Life! The sanctity of Life! Thank God we have a Supreme Court manned by Life lovers! The Supreme Court may just ensure that the scientist, Dr. Larry Abrams, who "corrected" the study's accurate findings that the patch delivered potentially lethal doses of estrogen, and all the future Larry Abrams's, is never held accountable for his deeds.
Forty deaths. How many lives did Charles Manson take? How many did the BTK Kansas killer take? Oh, if Manson only knew that he had to work for a Fortune 500 company to kill indiscriminately. If Dennis Rader only had a PhD and justified his 10 BTK killings as a "correction," he'd be a free man, playing golf every day of his retirement.
No but this is different. These pharmaceutical companies need to earn their money back. How else can they stay in business? Need to earn their money? Since when has capitalism guaranteed an entrepreneur that they would make millions and stay in business forever? Would the public be outraged had McDonald's knowingly sold cheese burgers made from cattle known to have Mad Cow disease?
How can I compare a brutal killing to collateral damage in the world of pharmaceuticals? Well, the chief moral transgression of the murderer is far more the results of his or her actions than the actual procedure. In the Tate/LaBianca murders, linked to Charles Manson, the procedure of death was indeed brutal. As Manson's surrogate, Tex Watson, stabbed a pregnant Sharon Tate to death, she cried, "Mother, mother..." until she died.
Tate may have suffered a more prolonged and horrifying procedure to arrive at death than the victims of Larry Abrams and Johnson & Johnson, but even 30 minutes is just a blink of an eye in a lifetime. The Tate/LaBianca deaths and the Ortho Evra deaths had one major thing in common: the results...death--unnecessary, cruel, irreversible. We're talking about years, decades and even half-centuries lost forever.
Perhaps Zakiya Kennedy, an 18-year-old college freshman in New York and fatal victim of the Ortho Evra patch, also thought about her mother when the pulmonary embolism that killed her took effect on her body. Victims of fatal pulmonary embolisms typically experience difficulty breathing, chest pain and cough up blood all while their blood circulation is thrown into chaos, weakening the healthy victim.
Kennedy felt pain in her head, leg and shoulder and dizziness. She suffered these perplexing symptoms long enough to relay them to her father. The dizziness, pain and terror reached a climax when Kennedy collapsed as she waited for the subway in New York City on September 23, 2004. "Mother, mother..." she may have cried in her confusion.
