If FEC finds that her campaign operated in affiliation with the PAC in raising $1.8+ million before June 2018 primary, it would open them up to “massive reporting violations,” former FEC Commissioner Brad Smith said. Ocasio-Cortez never disclosed to the FEC that she and her campaign chair controlled the PAC while supporting her primary campaign (backing 12 Democrats during 2018 midterms; only Ocasio-Cortez won. “If the facts as alleged are true, and a candidate had control over a PAC that was working to get that candidate elected, that candidate is potentially in trouble and may have engaged in multiple violations of federal campaign finance law, including receiving excessive contributions,” said former Republican FEC Commissioner von Spakovsky.
