Overview: Why New York's Legislature's Plan to Computerize Our Electoral System Is Unconstitutional The success of New York's electoral system has depended on the ability to see how our votes are counted. We cannot see how optical scanners or DREs count our votes. We cannot see malicious coding that steals our vote and erases itself. Software-driven voting machines expose the results to known and new risks of unprotectable fraud. Petition the Court to declare computerized voting in NY unconstitutional.

Open letter to NY citizens, election workers and election commissioners I will pursue litigation to challenge the state legislation and hope that our judicial system will rise to the occasion.Courts never like to find statutes unconstitutional,but this is our system of checks and balances and when a legislature behaves as carelessly as to permit the removal of our safeguarded electoral system, only to force its replacement with a highly vulnerable system,then it is to the courts we must turn.

Alarms Should Go Off Whenever the Discrepancies Between the "Official" Results and the Polls Can't Be Explained In all other countries we understand that when the "official" results are so different from the polling results, the "official" results must be questioned. But in the past 6 years which have seen the rise of computerized voting the U.S. insists its "official" results are sacred so the polling results must be rejected and with it the forensic evidence that would reveal the rotten electoral system of computerized voting

The Department of Justice v. New York State v. The Citizens of New York There are no DREs nor optical scanners which aren't capable of being rigged without detection. NYS officials want to buy these machines anyway, but first it wants to run testing certification on them. The DOJ wants New York to buy these machines now, untested. New York Can't Purchase Voting Machines from any Vendor Asserting a Proprietary Right to Conceal Information from Public If the New York State Board of Elections certifies any of voting machine made by ES&S, Sequoia, Avante, Diebold or Liberty, it will be in violation of New York's Laws. All of these voting vendors are prohibited from contracting in New York State. New York, the only state not to have purchased machines, is on notice that not only the vendors, but their products are too shoddy to vote on.

Avante's (Not Very Good) Offer to New York Voters “Comply with the law, or take your business elsewhere” is an excellent response to a vendor who essentially said to New York - take my business on my terms or we vendors may not want to do business with you, New York. However, I think all of us have a tendency to become myopic when we're passionately in the center of the debate. Why We Must Speak Out New York is the only state not to purchase computerized voting systems. The 2006 National Media Reform Conference Ignored the Greatest Threat to its Existence The Media Reform movement relies on legislative lobbying, pressuring Congress and the FCC. Governments cease be susceptible to such strategies once they no longer require voters to stay in office.
