Quotations from brilliant people can fill many pages on issue of "We the People"" and corporations. The Founding Fathers had consensus during the Constitutional Convention that individuals who have money & land, gather and gain power and become corrupt and tyrannical. Corporations are not a person, regardless of what you have heard. Our Constitution is split into two areas where the government has duties while individual citizenry has rights. The argument that corporations are people came from a note written on the margin area of a Supreme Court decision in Santa Clara County v Southern Pacific Railroad, 118 U.S. 394 (heard 1886, decided 1888) [the numbers that follow the name of the decision means published book of the United States Supreme Court, book number 118, beginning on page 394] at issue was if a corporation could be taxed differently than an individual.
The note of the court Reporter (Clerk of the court, also a former Rail-Road Attorney) was intended to relay the "intent" of the Supreme Court upon remand of this particular decision. A lazy, corrupt and not self-reflecting Supreme Court carried the "margin note" of the court Reporter as definition.
The Supreme Court is no stranger to making huge mistakes in their decisions. In 1837 the Supreme Court released a decision Dred Scott v Sanford, 60 U.S. 393, where the court decided a black man is property. Nowadays, Dred Scott is called a mistake where the Court decided people are property. In January 2010, the Supreme Court released a lengthy decision 558 U.S. 550 named Citizens United v Federal Elections Committee, in essence saying "property is people".
In the time-frame from the Santa Clara County to the Citizens United decisions are a flurry of Supreme Court decisions creating a corporation as a separate entity, protecting the decision-makers of the corporation and wealthy backers of the corporation from civil suit, court ordered restitution. While a corporation is fined and huge Billions of dollars in restitution, the decision-makers that directed the unlawful conduct of the corporation and wealthy backers collect their millions and a long list of assets from the corporation with impunity. Millions paid in unlimited amounts to political activities of our country.
What are these corporations, which include foreign funds, going to do with these donations to political activities? You, as the customer, will be charged more for their products to re-coup the funds utilized to political activities. The same will occur with the wealthy trying to recoup the tens of millions of dollars they donated to the electoral/political system of these United States.
What are we fighting for? We want our country back!
Once the Supreme Court has released a bad decision, as in Citizens United, there are only two ways to change such a decision. We can wait for 100 or 200 years to see if the Court reverses itself, or we can pass an Amendment to the Constitution.
We are also not politically naÃ¯ve. We know there is no single proposed Amendment that says everything just perfect to make it through Committee in either House of Congress. We also know that when Congress starts hearings on a proposed Amendment regarding corporations, the rats will come out from all hidden corners to speak against such an Amendment.
No single group can refute and progress the Amendment without the involvement of ALL other groups with their different Amendments and the time to begin lobbying both Houses of Congress, including their vote, is where a pure Amendment can leave Committee to be voted upon on the open-floor of each House of Congress.
All the other issues people hold dear to their heart will be addressed upon the fall of the corporate "coup d'etat" that is upon all Three Branches of our government. The involvement, activism of all of the citizenry being well informed shall gain control of their government.Posted by Paul Winger
