We have a long way to go.
But Harold Koh would not have to make a fool of himself before Congressional committees if Congress had passed Section 1034. In any future war with a claimed tie to al Qaeda (on the opposing side, not the "good" side as in Libya) Koh or his successor would have been able to point to a law on the books and read it as it was written.
We took that away.
