As applied to the United States, we have a Constitution which stands in the way of applying the fully-developed Nazi model of the Unitary Executive theory. But we can come close to it, even under our Constitution, if somehow the Congress and the Courts can be neutralized, except to rubber-stamp decisions made by the President. The first step would be to assert that the President has Constitutional authority over all parts of the Federal Government except those few parts which specifically belong to Congress or The Supreme Court; and that neither Congress nor the Supreme Court has any authority to interfere with whatever the President feels he needs to do, particularly in time of perpetual war, when his "inherent powers" are the greatest, in order to "protect us from our enemies."
This is already happening, as we now see in his Presidential statement of Dec. 30, 2005, where he blatantly announces that he denies his obligation to execute a duly-enacted Law, in this case the Anti-Torture rules recently passed by Congress and signed by himself. (Please see www.whitehouse.gov)
Sadly for all of us, President Bush now has the opportunity to appoint yet another Justice to our Supreme Court. A majority on the Court, under our Constitution, has the power to overturn all Stare Decisis precedents, and interpret the Constitution any way it chooses. And if the President illegally sends the Federal Military to enforce the Court's decisions, who will be able to stop them?
Judge Samuel Alito is a staunch supporter of the Unitary Executive theory, although he probably doesn't even know about its Nazi background. And he helped to develop the very "signing statements" applications that Bush used to subvert the anti-torture provisions, mentioned above. So there can be little doubt that he would be likely to do everything in his power on the Supreme Court to turn this dangerous theory into Law, by deciding cases in its favor. For instance, if Congress challenges Bush's authority to conduct wiretapping and torture, the case would go to the Supreme Court. And if Alito could assemble a majority on the Court, the Unitary Executive theory would be well on its way to becoming the Law of the Land, in all respects, by Supreme Court decision.
This would turn our President into a Unitary Executive Dictator and turn our Constitution upside down, re-establishing the exact kind of tyranny it was intended to prevent.
