The constitutional infirmity in excluding Massachusetts' Senator from participating in the process by which Sessions was appointed attorney general raises a question about the constitutional validity of Sessions' appointment and of actions taken in pursuance of that appointment.
What Alexander Hamilton called "the vigilance and weight of the state governments" is needed to protect against "subversion of our liberty," even when tyranny advances in small steps.
