Trump “reprogrammed” military funds after declaring a border emergency. The move was challenged by ACLU on behalf of Sierra Club and Southern Border Communities Coalition, arguing that Trump’s declaration was “made solely out of disagreement with Congress” on funding; the wall would be devastating to the environment. A 2nd suit to block the construction was filed by 19 states; CA AG Xavier Becerra: all “President Trump has succeeded in building is a constitutional crisis, threatening immediate harm to our state.”

Gilliam: government presented no new arguments answering his previous concerns when he issued a temporary injunction last month citing Congress’ control over federal expenditures, “even when that control may frustrate the desires of the executive branch.” Trump's action “does not square with fundamental separation of powers principles.
