Yes, there is much that is uncertain here,
and intent may well be a large part of it.
I don't know what you mean by "she didn't install
the server" -- no, presumably she did not do the technical
work, but she had it installed in her house in
Chappaqua. I'd say she did install the server,
in the sense that, without her approval, the server
would not have been installed.
The illegality of the private server in not spelled out in
the law, you're right -- however, it's hard to argue that
the existence of the server isn't the vehicle for a prima
facie case on violating laws on security and archiving
government information.
As the federal judge (Clinton appointee) sitting on the
server case brought by Judicial Watch has said,
the Clinton server set-up "boggles the mind."
We're nowhere near the end of this, I'd say ;-)))
