Jeffrey Toobin: How Romney vs Obama Will Change the Supreme Court

The composition of the Supreme court is one of the big arguments for voting for Democrat Barack Obama. But last night, I asked Supreme Court expert Jeffrey Toobin, author of the new book, The OATH, about how the court would change if Obama or Romney were elected. The answer was a bit surprising.

The composition of the Supreme court is one of the big arguments for voting for Democrat Barack Obama. 

But last night, I asked Supreme Court expert Jeffrey Toobin, author of the new book, The OATH, about how the court would change if Obama or Romney were elected. The answer was a bit surprising.

 
Toobin spoke at the New Hope Solebury High School. 
I asked him a question after his talk. 


He basically replied that unless there's illness or death, it won't make a difference. 

Most likely, if Obama wins, Ruth Bader Ginsberg will retire and Obama will replace her. 

The oldest Republican appointees are in their seventies, so it is likely that they'll hang on until the next election, hoping for a change in party control of the White House. 

If Romney wins, Toobin predicted that Scalia would retire, and maybe Kennedy. If Obama wins, they'll stay on. 

That's it. 

Bottom line, voting based on Supreme Court appointee opportunity will have minimal effect, unless someone gets sick or dies.
