Imprisoning probationers for failing to pay court debts was found unconstitutional in 1980.In Bearden v. Georgia, the Supreme Court ruled that such practices violated the Equal Protection Clause of the 14th Amendment - but states throughout the country have begun openly disregarding these principles in their efforts to balance their budgets.
