AN END TO LIFETIME APPOINTED SUPREME COURT JUSTICES!

I have an idea, which will return Sanctity to the Supreme Court (SC) through a Constitutional amendment. As it now stands changes in government administration leaves the appointments on the SC to blind luck of the draw-a shoot of the dice, whomever happens to be in Office when justices die or need to retire.

I have an idea, which will return Sanctity to the Supreme Court (SC).

As it now stands changes in government administration leaves the appointments on the SC to blind luck of the draw-a shoot of the dice, whomever happens to be in Office when justices die or need to retire.

True justice requires prudence and there needs to be precision and method in such appointments and when they occur should NOT depend on luck of the draw or a throw of the dice. Therefore, I suggest a tenure system of 9 years. Right now America is stuck with some Supreme Court members whose tendencies are beyond fascism. They never vary their vote, always it supports self-interest, and always it favors the powerful against the people, Justices who have an agenda, rather than an open mind, and who serve further and with contempt and anger.

This would be an amendment, which gives us a tenure system. It would give us a period to server and learn about justices, as they perform. A system which staggers the nomination to the court so that all members are staggered on a different time table/schedule for appointment, initially for 3 years, with a renewable tenure at the discretion of the president who nominated a justice, for 3 more years, with a second renewal possible for 3 years. At the final renewal, it can be decided whether or not to allow this justice to be a part of a "Graduate SC Advisory Committee" a sort of board of advisory directors to the Supreme Court.

It is with a second sight, that I say further, that as a professor who serves on many Boards of Directors of corporations and Charities, who has interviewed many hundreds of other professors, many of which are brilliant men and women, that I find it difficult to accept that there are in a lifetime only 11 people in America with the knowledge and wisdom to serve on the SC. We have seen the horrible mistakes that have given us criminal/fascist court members who serve at the crass beck and call of corporate and political power and money mongers, and who serve a "lower god" the god of materialism, avarice and lack of empathy. I say we support a higher God the God of justice for all, citizens or not, wealthy or not, religious or not.

I say we support an SC, which is free of friends in government and corporate high places.

Perhaps we should also allow that High Court to vote on its membership and retain some for their own non-voting, Emeritus board of advisers? Their pensions should be for life, but not their service on the SC.


 

Professor Bagnolo has majored in: Cultural Anthropology, Architectural design, painting, creative writing. As a child prodigy, abed with polio for almost two years, he was offered an opportunity to skip three grades at age 8.
