Mukasey and Bush want to declare the entire globe, including the USA, a "battlefield" in which anybody designated by Bush himself as "Enemy combattant" is locked away forever without right to legal counsel. I personally think there is a message in this for everyone. On the one hand, I think the ACLU is absolutely right for going after the FBI for targeting activists and quelling free speech. On the other hand, some activists need to learn to do their thing in a non-violent, orderly manner and not heap trouble on the heads of other activists. Those engaging in violent protest are affecting free speech nation-wide. Live and learn?
