A recent decision by a federal court is bad news for anti-torture activists. The decision raises serious doubts that a program of torture can be restrained via the courts. The decision seemingly abrogates what had been a judicial prerogative —the very concept of judicial review. It raises a grave question: in what other way can torture be ended?
