The New American Federalism: the Surrender of States Rights to HOAs
(3 comments) Today, we are witness to the acceptance of the quiet emergence of a layer of independent republics as a third level of government in our American federation. Public-private partnerships that utilize restrictive covenants, which are permitted to supercede public laws and ordinances, regulate and control the people within their territorial bounds. This layer, creating a New America, is referred to as homeowners associations.

Goldwater Institute supporting HOA secession?
(1 comments) Are we seeing a new wave of legal-academic aristocrats offering a supposed better form of government. The Goldwater Institute called for "enhanced protection against local government . . . by enacting local constitutions" and for counties to replace land use with "privately enforced restrictive covenants" (emphasis added).

Are HOAs exempt from claims of constitutional violations?
(1 comments) How can private governments supported by special laws that deny fundamental rights and freedoms not be a constitutional issue? Or that these agreements that do not need to be read or explicitly signed permit the surrender of these fundamental rights do not raise constitutional questions.

HOAs: Exchanging individual property rights for property values
(1 comments) Homeowner associations are continuing to spread across the country. Yet, very little is said by the real estate special interests about the loss of individual rights and freedoms. These private government authoritarian regimes have the mission to protect property rights, first and foremost, and there is no bill of rights protections within the private HOA "constitution".
