The oldest human right defined in the history of English-speaking civilization is the right to challenge governmental power of arrest and detention through the use of habeas corpus laws. Habeas corpus is roughly Latin for "hold the body," and is used in law to mean that a government must either charge a person with a crime and allow them due process, or let them go free.



Last autumn the House and Senate passed, and the President signed into law The United States Military Commissions Act of 2006, which explicitly strips both aliens and Americans of the right of habeas corpus, the right of recourse to the courts (as provided in the Fifth through Eighth Amendments to the Constitution), and denies appeal through mechanisms of the Geneva Conventions to those designated to lose these rights by the President.

As the most conspicuous part of a series of laws which have fundamentally changed the nature of this nation, moving us from a democratic republic to a state under the rule of a "unitary" President, the Military Commissions Act should be immediately reversed. When a demi-tyrant like Vladimir Putin begins lecturing the United States, as he did just a few days ago, on how our various behaviors over the past five years have "nothing in common with democracy," we should pay attention.

This attack on eight centuries of English law is no small thing. While the Republican's (and 13 Democrats in the Senate) purported intent was to deny Guantanamo Bay Concentration Camp detainees the right to see a civilian judge or jury, it could just as easily extend to you and me. (Already two American citizens have been arbitrarily stripped of their habeas corpus rights by the Bush administration - Jose Padilla and Yasser Hamdi - and there may be others.)

Section 9, Clause 2, of Article I of the United States Constitution says: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

Alberto Gonzales testified on January 18th before Congress that "there is no express grant of habeas in the Constitution. There is [only] a prohibition against taking it away."

While there are many countries in the world where all power and all rights are reserved to the government, and then doled out to the people by constitutional, legislative, or executive decree, the first three words of our Constitution clearly state who in this country holds all the power and all the rights: "We the People."

Our Constitution does not grant us rights, because "We" already hold all rights. Instead, it defines the boundaries of our government, and identifies what privileges "We the People" will grant to that government.

When Gonzales suggested we have no habeas corpus rights because the Constitution doesn't grant them, his testimony betrayed a breathtaking ignorance of the history and meaning of the United States Constitution. And, because his thinking probably reflects that of his superior, George W. Bush, Gonzales' testimony demonstrates the urgency with which Congress must act to repeal the many laws, signing statements, and executive orders that have been issued by this administration.

But particularly, and first, with regard to habeas corpus.

Abraham Lincoln was the first president (on March 3, 1863) to suspend habeas corpus so he could imprison those he considered a threat until the war was over. Congress invoked this power again during Reconstruction when President Grant requested The Ku Klux Klan Act in 1871 to put down a rebellion in South Carolina. Those are the only two fully legal suspensions of habeas corpus in the history of the United States (and Lincoln's is still being debated).

The United States hasn't suffered a "Rebellion" or an "Invasion" since Lincoln's and Grant's administrations. There are no foreign armies on our soil, seizing our cities. No states or municipalities are seriously talking about secession. Yet the Attorney General says we have no rights to habeas corpus, and the Military Commissions Act now backs him up.

The modern institution of civil and human rights, and particularly the writ of habeas corpus, began in June of 1215 when King John was forced by the feudal lords to sign the Magna Carta at Runnymede. Although that document mostly protected "freemen" - what were then known as feudal lords or barons, and today known as CEOs and millionaires - rather than the average person, it initiated a series of events that echo to this day.

Two of the most critical parts of the Magna Carta were articles 38 and 39, which established the foundation for what is now known as "habeas corpus" laws, as well as the Fourth through Eighth Amendments of our Constitution and hundreds of other federal and state due process provisions.

As always, Thom's piece includes a call to action. The cons are ripping apart the laws that 'we the people' fought so hard to establish and maintain, and there's barely a peep to be heard in response. They're going after the most basic of rights and most people are less concerned about this than they are a trans-fat ban. Contact your legislators on every level, and talk about it. Thom's put this together, now spread it.

Gonzales is ignorant concerning habeas corpus? No -- I fear not -- millions upon millions of ordinary people know about it -- and many more by principle if not by name. This is not ignorance -- this is the deliberate destruction of constitutional and human rights, just as was his support for torturing people. These people are not ignorant, but evil, sociopathic, and traitorous monsters who want absolute dictatorship. Please, no more excuses and soft-pedaling what we all know to be the truth in polite terms.

November 2nd changed everything; in a post November Second world we must boldy and plainly speak the truth and demand that law and justice prevail.

I concur with the bluepiligrim

but also, every time there is a 'Russian reference', you better not... you know.. use it. For your own sake, Tom and others. You, folks are not good in 'Russian' issues.

1. Putin did not lecture 'us'. He lectured those in power and he knows them well. We are not in power and we better take it back. The habeas corpus or anything like that only makes sense if it is protected by the power. I asked several times why did not the Louisiana Attorney Generalpress the charges of criminal negligence against Bush, Brown and Chertoff after Katrina massacre (no other name for it). And the answer is ... no comment. So, Bush and Co. do that because they can... That's American way, right?

2. Khrushev did not yell. He just asked once and as a matter of fact, those people who listened to him were not 'elected'. Also, Mr. Hartmann mixes apples and oranges- Stalin never 'threw people into the psychiatric wards'; he just tortured and killed them, and he never ' violated the laws.' His cronies violated only the spirit of the Constitution of the USSR (a symbolic document) but ALL purges were covered by the 'Special Laws' and that's where we are going too. Military Commissions mimic the Stalin's ' Special Commissions' to the letter and that is what I want to hear from the person who 'worked in Russia'.
3. I believe that 'good servants' like Mr. Gonzales and Mr. Yoo and others, not only are evil to the core but they 'help the evil' by using the idiots and vampires at power for their own little purposes. The fact that the draft of the Patriot Act was available before 9/11 proves it.
We deal with the people without honor, without dignity and without morality. Those are the ones at power now. They are not 'us'.

Yes, the assault by our government (including both Republicans and Democrats) on the liberties acknowledged by the Constitution is deliberate and knowledgable. Not an accident. Not done in ignorance. Intentional and concerted. In addition, writing to your representatives may be helpful but most likely will not. Do not, however, lapse into despair and passivity. Remember, Jefferson wrote:

"God forbid we should ever be twenty years without such a rebellion. The people cannot be all, and always, well informed. The part which is wrong will be discontented, in proportion to the importance of the facts they misconceive. If they remain quiet under such misconceptions, it is lethargy, the forerunner of death to the public liberty. ... What country before ever existed a century and half without a rebellion? And what country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms. The remedy is to set them right as to facts, pardon and pacify them. What signify a few lives lost in a century or two? The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants. It is its natural manure." and he further stated,

"To preserve the freedom of the human mind then and freedom of the press, every spirit should be ready to devote itself to martyrdom; for as long as we may think as we will, and speak as we think, the condition of man will proceed in improvement."

How very prescient he was. And in his prescription for remedy.

9/11 was an inside job. The fact that they were willing to kill 3000+ Americans with a false flag operations and thousands of 1st responders from the effects of the polutants they breathed... and hundreds of thousands of innocent mothers, children and fathers in the countries criminally attacked by our forces ... all of these underscore just how evil these folks are. And what they are willing to do to YOU.

During one conversation, Rockefeller asked Russo if he was interested in joining the Council on Foreign Relations (CFR) but Russo rejected the invitation, saying he had no interest in "enslaving the people" to which Rockefeller coldly questioned why he cared about the "serfs."

Repeal the Military Commissions Act ... STOP Military Budget

Very good Thom. It seems to me we just need to stop the military budget. And of course, indict, arrest and jail the criminals who lied to Congress and to the American people. Very simple.

Thank you for this very well written and thoughtout article. You are center target. Putin is about as much of a dictator as Russian has always had. One would have hoped they had used this opportunity to create a free and safe society, but alas, it is not to be.

The good think about our government, we will get a new one come 2009 and without a single person being killed. We are only limited by the ignorance of people not knowing enough to vote for whom they should.

Democracy begins with YOU

I first heard this expressed personally by Mr. Hartmann on one of his AAR programs a couple of weeks ago, a program I try hard to catch each and every weekday.

I thank him for this as I can now email the article itself to Senators Boxer and Feinstein, Rep. Pelosi and Stark. I urge everyone to do the same to their own respective representatives. Further I will raise this issue at the local Green Party and Democracy for America gatherings.
