Suggestions For A New Bill Of Rights

Introduction

There would really be no "Rights", in a discussionary sense, if there were no "highly" intelligent, Individual participant group system creatures (Humans) to need, discover and declare them.

We first feel the "need" for the support and protection of "Rights" when We experience an unfairness or injustice. Once determined what the Right should be, it is applied and enforced, at first, by Individual strength to assert it. On this level, Rights are selfish and limited to the strongest. The weaker Individuals become subject to the tyranny of the strong Individual's asserted Rights. We should be ever aware of the tendency of a "Right" to become an "entitlement" or "privilege" over others.


Until the group can come to agreement on Rights that equally apply to everybody (that qualifies for them), tyranny and injustice continues.

The Individual assertion, in a Natural Human Process, becomes the assertion of the "few", over the "Many".

Then, as this "process" continues through time, the "The Many" develops and achieves assertion of Rights, injustice begins to transform to True Justice. This comes slowly and sometimes painfully. The Many are slow to depend on each other, to develop the strengths necessary to establish and practice Justice and Rights"because The Many is made up of Individuals"and it takes a very long time for Individuals to "rise" above themselves and find the common ground where the group can prevail.


This Part of this suggested New "Direct Democracy Republic Common Wealth of The United States Of America Constitution", is a continuation of this Rights development "process". Now, there are basically three "camps" of "The Many" and represents around 80% of the American Populace.


One "camp" is strongly Individualistic and finds adherence and common cause through its fear of the power of co-operation of the social group and its need to make the Individual, in some ways, a part of the whole. This camp practices a coerced kind of cooperation. This camp is very jealous of the kind of Individual Rights that enable exploitation of others. It hates the idea of limits of decency, or the limits indicated by "Finite Existence" on a Finite World. It thinks of Peace as the state where conquest has subjugated, for wealth and power, any who have less strengths. It is proud and blind to the ideas of Equality Of Opportunity and Fairness. Justice is what it decides is appropriate to maintain its dominance. One would think that "Limits" would be an element of this conservative perspective.


The second "camp" has a lot of Individuals that are trying to learn the Art Of Cooperation, for the sake of a Better and Improved Nation. This camp has far less of the "Rich and Powerful" in it and more of Us who have really not done very well with capitalism(as practiced in America). This camp has a stronger Fairness Awareness and is more sensitive to Human depredations of Our Planet and Us. This camp is more comfortable with concepts of limitations.


Then the third camp is all that is left between the first two. This camp has a lot of the "Undecided" and "uninterested" in it. The disenfranchised. This camp seems to be the smaller of the three camps, but might be "growing".


I think the inclusion of a new well-reasoned and designed "Bill Of Rights System" would strengthen the social contract principles and precepts of Our Third Constitution; the "Direct Democracy Republic Common Wealth Constitution Of The United States Of America", just as it did for Our Second Constitution. The "Bill Of Rights" of the "Second Constitution", was the best Rights, so far, for The Republic Common Wealth American People (Middle and Worker Class Citizens) and the Wealth and Power Class, in Our Second Constitution and should be even Better for Us in this one. There should be More Rights declared than before, because We are more aware of shortcomings in Our present list of Rights, as established in Our Second Constitution. The Evolved complexity of Our Society calls for more Rights to be declared and embraced by Us"in order to strengthen the promotion of the General Welfare within Our Diverse Population.

This "Part 2" is a suggested New American Bill Of Rights into the new "Third American Direct Democracy Republic Common Wealth Constitution". It will give Us More guarantees, safeguards and protections from Our "Enemies", within as well as without, than We had the benefit of before.
