Kathleen Sebelius was confirmed in a 65-31 Senate vote as the United States Secretary of Health and Human Services and sworn in at the White House.
The 9th Circuit Court of Appeals in San Francisco ruled against the United States Justice Department plea of “States Secrets Privilege” to halt an ACLU lawsuit on behalf of five detainees against a subsidiary of Boeing for arranging flights for the Bush administration’s “extraordinary rendition” program, in which terrorism suspects were secretly taken to other countries and, the detainees claim, tortured. In the language of the Court Decision:
“Acceding to the government's request would require us to ignore well-established principles of civil procedure. At this stage in the litigation, we simply cannot prospectively evaluate hypothetical claims of privilege that the government has not yet raised and the district court has not yet considered."
Day99/April 29th/Wednesday: The President, Vice-President officially welcomed United States Senator Arlen Specter to the Democratic Caucus and conducted a press conference with Specter at the White House in the Diplomatic Room. Later in the day, Specter voted against the President’s 2010 $3.4 trillion budget.

“I believe that waterboarding was torture. And I think that the -- whatever legal rationales were used, it was a mistake.”
“I am gravely concerned about the situation in Pakistan, not because I think that they're immediately going to be overrun and the Taliban would take over in Pakistan; more concerned that the civilian government there right now is very fragile and don't seem to have the capacity to deliver basic services, schools, health care, you know, rule of law, a judicial system that works for the majority of people.”
“I do think that having Arlen Specter in the Democratic Caucus will liberate him to cooperate on critical issues, like health care, like infrastructure and job creation, areas where his inclinations were to work with us but he was feeling pressure not to.”
