I think that we should pay close attention to the fact that only in the first case is society put at risk for further crime to be committed. We should also pay close attention to the fact that prisons cost around 10% of many state budgets. So another way of looking at it is to ask "Where are our priorities?"

We should also take a careful look at what the motivations are for prosecution. There is one deep pocket here, and that is Pelham.  If the chief is convicted in any way, then Pelham probably has some degree of liability for what happened. Believe me, civil litigators are salivating over a payday on this event.
