A GA couple, threatened with foreclosure, takes a stand against megabanks! Jay & Beverly Fenello, acting as their own counsel, filed a lawsuit in the Cherokee County Superior Court against Bank of America, Shuping, Morse & Ross LLP and The Bank of N.Y. Mellon, charging 13 causes of action, including fraud, bad faith, equitable estoppel, as well as violating the Fair Debt Collection Practices Act, the Truth In Lending Act, and the Real Estate Settlements Procedure Act. The 13-count complaint further accuses the defendants of bad faith based on false verbal instructions; violating the FDCPA as BofA was acting as a debt collector for The Bank of N.Y. Mellon; and failed to comply with a consent order in response to the 'robo-signing scandal,' where more than 100,000 falsified and fraudulent affidavits were filed by large banks in support of illegal foreclosures. |
