Should Obama Use Bush's Powers to Restore America?


Would you support a president Obama if he were to use the Executive powers Bush grabbed and abused to enable America to realize its constitutional ideals?

It's been nearly two years since Congress handed George Bush dictatorial powers via The Military Commissions Act of 2006. That, and God knows how many unchallenged Executive Orders transferring even wider powers to the President, have served to destroy the constitutional protections we enjoyed for 200 years.

However, George Bush, by signing into law the Military Commissions Act Of 2006, may have performed a service for this country greater than he could possibly have imagined.

This Act legalizes torture and allows the President to interpret the Geneva Conventions as he sees fit. More importantly, it virtually eliminates the Habeus Corpus provision in the U.S. Constitution, which provides for a person accused of a crime the right to hear the charges against them, the evidence against them, and the right to a trial.

Now, quite literally, the President, or a tribunal he appoints, can name ANYONE for ANY reason, an "enemy combatant" or a "disloyal person", have them arrested without charge, evidence, or trial, and have them held incommunicado FOREVER. And, neither the President nor his tribunals are answerable to anyone at all.

Habeus Corpus is a concept incorporated into English Common Law since 1215 A.D. Our Constitution is based on English Common Law, and Habeus Corpus was included as it was the only thing that guarded us against the tyranny of a police state or dictatorship. I mourn its passing.

BUT HOLD ON A MINUTE!!This part of the Act, as evil, vile, and abhorrent as it is, may be the ONLY legal way to restore our democracy, and, for the first time ever, finally establish the ideals on which our nation was founded. You know the ones; "All men created equal", "Freedom of religion", "Liberty and justice for all", and so on.

All it would take is a Democratic President and a pragmatic executive team committed to acting in the best interests of the nation. (as the presidential campaign unfolds, this is problematic, something that in my naivete I failed to foresee)

In other words, a President willing to to actually defend the Constitution he swore to uphold, by using the very law described here to summarily "disappear" EVERYONE who has worked over the last several years to subvert, weaken, and destroy our democracy.They would include all persons who colluded, plotted, bribed, aided and abetted, or enriched themselves in any way from the well- organized effort that has overthrown our Constitution.

Admittedly, it's a big list--Politicians (any level, any party), lobbyists, CEOs and directors, propagandists and "think tanks", media, "religious" leaders, political appointees, war profiteers, neocons, defense contractors, military heirarchy, attorneys, judges, etc.How many people? 50,000, 150,000, 1,000,000?-- The number is immaterial compared to the 300 million people living here without rights, or the countless hundreds of thousands around the world whose deaths they are responsible for.

Is it possible? Absolutely!

Is it legal? Absolutely!

Is it moral? I think so. At least it is no less moral than what has been done to this country by these people, and it's bloodless. If anyone has a more elegant solution to our national nightmare, please let me know.It's ironic isn't it, that the very instrument used to destroy our Constitution can also be used to restore it.
