Supporters of open source software, voter-verifiable paper trails, ballot marking, sorting, scanning, or counting machines, and H.R. 550, often use weasel words. "Ballot of Record" may not mean what you think it does.

A very strange thing that seems to slip by people is when open source, paper trail, and other machine advocates say that the paper ballot will be the "ballot of record." This does not mean that the paper ballots will ever be counted. It merely means that after the machine count is announced and the winner declared, the paper trail and/or paper ballots will be retained just in case some renegade elections official or court permits a recount. A record is something that is kept in case it is needed and many elections officials and courts have decided that recounts weren't needed. People seem to think that "ballot of record" means the ballots that will be counted on election night, or ballots that will at least be counted at some point, even if it is too late to matter. All "ballot of record" means is that some type of paper trail or ballot will be produced and retained just in case somebody contesting an election manages to obtain permission to count them (which, as many of us have found out the hard way, is easier said than done). The paper ballot must be the ballot that is counted on election night, and the ballot that takes precedent over all other "ballots" even if we can't force such sham "ballots" out of our elections system. With any luck at all, by supporting H.R. 6200, which calls for hand-counted paper ballots, we can get rid of the invisible ballots and the weasels promoting them.
